These Terms of Service (“Terms”) govern your access to and use of Smarty Pants Trivia (the “Service”), operated by Smarty Pants Trivia (“we”, “us”, or “our”) at playsmartypants.com. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Smarty Pants Trivia is a web application for creating and hosting live trivia events. Hosts build question decks (from scratch, from our templates, or with AI assistance) and run games that players join from their phones. Features and limits vary by plan.
You sign in with a magic link sent to your email. You are responsible for keeping access to that email secure and for all activity that occurs under your account. You must be at least 13 years old (or the minimum digital-consent age in your country) to create an account. Hosts running events for children are responsible for any consent required from parents or guardians.

We may suspend or terminate accounts that violate these Terms.
You retain ownership of the questions, names, images, and other content you create or upload (“Your Content”). You grant us a limited license to host, store, process, and display Your Content solely to operate and improve the Service. You are responsible for Your Content and for ensuring you have the rights to use it (including any third-party trivia material, logos, or media).
We provide prebuilt question packs and an AI question generator for convenience. AI-generated questions and answers may be inaccurate or out of date — you are responsible for reviewing them before use. Template and AI content is provided “as is” with no warranty of accuracy.
Paid plans and add-on credits (including AI top-up credits) are billed through our third-party payment processor. Subscriptions renew automatically until cancelled; you can cancel at any time and your plan remains active through the end of the current billing period. Except where required by law, payments are non-refundable. Prices and plan limits may change with notice. Purchased credits are consumed as described in the app and are non-transferable.
The Service relies on third parties including our hosting and database provider, our AI provider, and our payment processor. Embedded media (for example YouTube) is subject to those providers’ own terms. We are not responsible for third-party services.
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim.
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. On termination, your right to use the Service ends; some provisions (such as content licenses already exercised, disclaimers, and liability limits) survive.
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, notify you. Continued use after changes take effect means you accept the updated Terms.
